By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

Your continued use of our Services after we have posted modified Terms indicates that you accept and agree to the changes.

You are solely responsible for your User Content and the consequences of sharing it. By uploading User Content, you represent and warrant that:

You own or have obtained all necessary rights to the User Content
The User Content does not infringe or violate any third party's rights
The User Content complies with these Terms and all applicable laws

You may not access or use the Services for any purpose other than that for which we make them available. You agree not to:

Use the Services to distribute malware or other harmful code

Some aspects of our Services require payment ("Paid Services"). If you choose to use Paid Services, you agree to pay the fees as quoted to you. We may change the fees for Paid Services at any time, but we will provide notice of these fee changes in advance.

If you do not pay the fees for Paid Services, we may suspend or terminate your access to the Paid Services. You are responsible for all applicable taxes, and we will charge tax when required to do so.

The Services may contain links to third-party websites or services that are not owned or controlled by MEZR. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that MEZR shall not be responsible or liable for any damage or loss caused by your use of any such third-party websites or services.

Disclaimer of Warranties

THE SERVICES AND ANY CONTENT OR INFORMATION AVAILABLE THROUGH THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MEZR MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR THAT DEFECTS IN THE SERVICES WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEZR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

IN NO EVENT SHALL MEZR'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO MEZR FOR THE PAST SIX MONTHS FOR THE SERVICES.

Indemnification

You agree to indemnify, defend, and hold harmless MEZR and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your access to and use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in San Francisco County, California.

Termination

We may terminate or suspend your access to all or part of the Services, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason. Upon termination, your right to use the Services will immediately cease.
